Дослідження особливостей державного регулювання обігу лікарських засобів в Україні та за кордоном

Abstract

Дипломну магістерську роботу присвячено дослідженню особливостей національного та міжнародного законодавств та практик у сфері обігу лікарських засобів. На основі проведеного аналізу особливостей державної політики щодо обігу лікарських засобів в Україні, а також дослідження нормативно-правового адміністрування у сфері обігу лікарських засобів визначено повноваження та компетенції суб`єктів публічного адміністрування у сфері обігу лікарських засобів як в Україні, так і за кордоном. В роботі розкрито особливості дозвільного, ліцензійного, реєстраційного та сертифікаційного провадження у сфері обігу лікарських засобів, визначено сутність та особливості контролю та нагляду як засобів державного регулювання на всіх етапах обігу лікарських засобів (створення, виробництво, зберігання, транспортування, контроль якості, імпорт, експорт, реалізація та утилізація лікарських засобів), а також визначено проблеми гармонізації вітчизняного законодавства з європейськими нормами та сформулювано пропозиції щодо шляхів удосконалення регулювання обігу лікарських засобів та механізмів управління у фармацевтичній галузі.

The master's thesis is devoted to the study of the peculiarities of national and international legislation and practices in the field of circulation of drugs. On the basis of the analysis of the peculiarities of the state policy regarding the circulation of medicinal products in Ukraine, as well as the research of regulatory and legal administration in the sphere of circulation of drugs, the powers and competences of subjects of public administration in the sphere of circulation of medicinal products both in Ukraine and abroad have been determined. The work reveals the peculiarities of permitting, licensing, registration and certification proceedings in the field of circulation of medicinal products, defines the essence and peculiarities of control and supervision as means of state regulation at all stages of the circulation of drugs (creation, production, storage, transportation, quality control, import , export, sale and disposal of medicinal products), as well as the problems of harmonization of domestic legislation with European norms were determined, and proposals were formulated on ways to improve the regulation of the circulation of drugs and management mechanisms in the pharmaceutical industry.
